In other words, they have no special rights. If the court believes it's in the best interest to children that the Grandparents be granted access or custody, then they'll order it. But, in the face of competent parents who wish the grandparents to have no access, obtaining.
An order of access is very difficult. Grandparents who have been involved in the day to day care of the grandchildren over an extended period of time, so they've been essentially playing the role of parent, they have a very strong case for at least access and sometimes even custody of the children. Another situation which grandparents have had great success, is when the parents are unable to care for their children as a result of perhaps mental illness, or addiction issues, or imprisonment for that matter. Alberta, Quebec, New Brunswick and BC have legislation.
Which acknowledges the importance of the grandparentgrandchild relationship, but it doesn't guarantee custody or access to grandparents. Ontario has legislation that's pending, but it's a private members bill so there's a good chance it will not be passed into law. Some of the saddest cases involving grandparents are those in which their child has died and the grandparents wish to maintain a relationship with the grandchildren, but the surviving parent does not want that to happen. Those are tough cases that the court has to grapple with and decide based on what is in the best.

I'm often asked what's the difference between the end of a common law relationship and the end of a marriage. Well there are similarities, and there are differences. The way common law couples are treated for the purposes of custody and access related to the children of course and support. It doesn't matter whether it was a common law relationship or marriage.
Really, it doesn't matter except if you're in a common law relationship for less than three years you're not eligible to get spousal support. That's not the case with marriage. So, support issues are treated the same way. Custody and access based on the best interest of the children. The big difference between a common law relationship ending and a marriage ending is how property division is dealt with. In a common law relationship there's an assumption that his is his and hers is hers. That is you don't have a right to share your partner's.
Property when you separate after a common law relationship. That's not necessarily the case in family law. In family law, there's an equalization of the value of property that was acquired during the relationship. So, his is his and hers is hers, but the value of the property acquired during the marriage is equalized. So if one person comes out of the marriage with a larger sum of assets, he or she has to pay half the difference to their spouse. Now there's a complicated formula so I'm just touching on the highlights of the differences,.
Joint Custody Versus Sole Custody in Ontario

I'm often asked, what is the difference between joint custody and sole custody Well, custody for lawyers means how you make decisions. In a joint custody regime the parents make decisions together. If one parent has sole custody, they make all of the major decisions. So, major decisions are those that relate to the health care, religious upbringing and education of your children. Of course, there can be some disputes as to what decisions are major, which ones are minor.
Day to day decisions are made by the parent who has the children under their care but those major decisions that have a significant impact on a children's lives are made jointly if you share joint custody. In Ontario the courts tend to assume that it's in the best interest of the children that both parents are involved in decision making but if there's evidence that the parents will be fighting and arguing and it will be not in the best interest of the children to have joint custody, then they'll order sole custody and give that.
Decision making part to one person. Now, often parents think that custody means the amount of time that the children spend with each parent. Well, that's not the case. Joint custody can occur even when the children are living primarily with one parent and the other parent just has access. So, often when people refer to joint custody, they assume it means that the children will be with both parents an equal amount of time. That is in fact, called shared custody. Confusing, isn't it Not sure why the term custody was used in two different contexts but from a legal.
Point of view, joint custody versus sole custody means how decisions will be made. Now, sometimes even if we have joint custody are going to have disagreements, so it's always best to see if you can work out those disagreements and come to a decision on your own, but if you need help, we sometimes send you to mediation where a neutral third party will help you discuss the issues and come to an agreement. Sometimes we have to go to court to get a judge to decide which point of view should.
Prevail, what's in the best interest of the children. Sometimes what we'll do is we'll hire a parenting coach who unlike a mediator can actually give you advice and make some suggestions as to what the best resolution of the issue is, and they'll help you work out an agreement. I think that fathers' role in parenting is absolutely crucial. I've brought up five children and I regret, frankly, that through much of my career I've not been able to find as much time as I should've done to spend with my children. And there are so many families now that are two earners with enormous pressures that I think we need to rejig and rethink many of our institutions to ensure that fathers and mothers have the chance and the time to spend with children. And what I'm thinking of is.
We haven't changed, for example, school holidays and school hours for generations, and yet there's been massive change in actually the pattern of families. We haven't looked at flexible working enough to ensure that everybody has the right to get flexible working, providing of course that their employer is still getting what they need. And I think we need to look at all of these institutional arrangements. Taking issues like this, like parenting fathers and mothers and making sure we look at all the potential things that we can do to help. Because we also know now that relationships, including particularly family relationships, are actually the most important things in making people happy and fulfilled. And that's something that I think government needs to think much more about, and think outside the box. Too many ministries think only about the particular things that they're concerned about whereas this is a classic issue where if we're really going to help families.
