How do I get Full Custody of my Children Seattle Child Custody Lawyer Eric Engel Explains
How do I get full custody of my children Hi! I'm Eric Engel, a Seattle child custody lawyer with the Engel Law Group. The first thing you need to find out is do you have a parenting plan in place right now A parenting plan is a set of rules that the court uses to determine who gets your child when versus the other parent. If you currently have a parenting plan then you need to stop and you need to consider filing a modification of the parenting plan because somebody already has custody of your.
Children. Now, if there's not a parenting plan in place then you need to file a petition for a parenting plan. Or if you're married, you're going to need to file for divorce or legal separation in order to get a parenting plan put in place. The court looks at a variety of factors in determining who should be the primary custodian in a parenting plan. The court is going to look at the strength and nature of your relationship with your child in other words, how strong is the bond.
That you have versus how strong is the bond with the other parent. Take a look at the stability of your life. Are you in a stable situation Do you have employment Is your employment flexible For example, if you need to, can you get off work early to pickup your child from school These are the sort of factors that the court will need to look at. Also, they're going to look at other factors such as drug or alcohol use, or if someone has a criminal history, or a history.
Of domestic violence. These last few factors can radically affect a person's right to see their child. In fact, they can result in supervised visitation if you have one of those factors present. Why am I telling you this Because you need to be aware what the factors are that a court considers when deciding who to place your children with. Are they going to place your children with you or are they going to place your children with the other person. We deal with these issues every day and we can help. Give us a call at 2066259800.
How Do Fathers Get Custody of Their Child
Hello, my name is Brian Galbraith and I'm the owner of Galbraith Family Law. We're a law firm of family law lawyers located in Barrie, Orillia and Newmarket. How does a father get custody of his children Now, there's a myth out there that fathers never get custody of their children. This is based on the historic fact that, traditionally, mothers were primarily responsible for the care of children and fathers were the bread winners. So it made sense, in those days, that the court would order custody to the mother since.
She was the one primarily looking after the children anyway. It was in the children's best interested to be with their mother. Nowadays, both mothers and fathers usually participate in the care giving and in earning the income for the family. As a result the Ontario courts are more inclined to order an equal time sharing regime for the children. If a father wants custody of his children, he needs to prove that it's in the best interest of the children that he has custody. A strong argument would be that he was traditionally.
The one responsible or primarily responsible for the care, and that he can continue to provide the care that the children want and deserve. Custody battles are often very nasty. They can take many months and even years to resolve and cost thousands of dollars in legal fees. The children often suffer when there's a custody battle between their parents. As a result we prefer to help our clients negotiate a settlement. One of the best processes to do that is called collaborative practice. That's a process where the parties agree not to go to court and they work with professionals to find a resolution.
To their petty issues and any other issues that they have to resolve related to the separation. It's a very cost effective process and keeps the power of decision making in the hands of the parents. Most importantly, it helps prevent the children from being in the middle of a battle between mum and dad. If this tutorial's been helpful, give it a thumps up. How do I get Sole Custody of My Children Seattle Family Law Attorney Eric Engel Describes a Case
I once had a client named Courtney who was going through a divorce and she was trying to get sole custody of her kids. Hi. I'm Eric Engel, Seattle divorce lawyer with the Engel Law Group in Seattle, Washington. In Courtney's case, we were able to show that her husband continued to have a drug and alcohol problem which interfered with his ability to care for her children. This allowed her to get sole custody of her kids when the judge finally decided who should get custody. She also got child support and she got a favorable.
How do I get 5050 Custody of My Children Seattle Family Law Attorney Eric Engel Describes a Case
Let me tell you about a story about a client who ended up going through a divorce trial and he wanted to go 5050 custody of his kids. Hi. I'm Eric Engel, Seattle divorce lawyer with the Engel Law Group in Seattle, Washington. I had a client named Sam who's trying to get 5050 custody of his kids. Unfortunately for him, his exwife or soon to be exwife had hired a really good divorce attorney and they were adamant about them getting sole custody. Now when we went through trial, we were able to show that the guardian ad litem.
The guardian ad litem is somebody who's hired by the court to investigate the parties and make a recommendation, we were able to show that the guardian ad litem made mistakes when she actually drafted her report and should have considered joint custody. As a result of our work there, we were able to get Sam joint custody of his children despite an adverse recommendation by guardian ad litem and despite them having a very good attorney on the other side. Why am I telling you this I'm telling you this because if you're in child custody.
How Do I get Child Custody For Fathers explained by Los Angeles Child Custody Expert David Pisarra
Hey Guys David Pisarra here with Mensfamilylaw. I want to talk to you today about the three ps of child custody. The most important factors when it comes to dealing with a child custody case that I look for and that a judge looks for. the first is Proximity. How close do you live to where the child lives How close do you live to where the child goes to school Where's your work located in relation to the school If everything is really close in proximity, we want things to be really close judges like that, it makes it easier for you to be a more.
Involved parent. Next up is paperwork. If you're going to come into my office and I need to have more time with my kid. THe first thing I'm going to ask you is do you have a calendar of all the time you've been seeing your child receipts which prove to me what you've actually been doing and some sort of tutorial or photos something to substantiate all of that so I can go to a judge and say, Your honor, here's all the time he's been using with his child and he wants more. And lastly, it's persistence. Persistence.
Is the hardest part for men in this whole process, because it can be so emotionally draining. We're playing with the time you get to see your child. It's the only time you're going to get to be a father to this child at that age and it goes really quickly and it's really fleeting and courts can be really time consuming and slow moving. You need to have the persistence to fight the battle and to stick it out and its really really hard and I understand that. So just to recap the three Ps of child custody when.
You're coming into us looking to get more time with your child. I want proximity. I want you living close to where the kid goes to school. I want you working close to where the child goes to school. I want you close to where the child lives. Paperwork, I want paper trail. I want calendars, I want photos. Receipts from movies receipts from Chuck E. Cheese. and then Persistence. I want you able to really stick through the fight. It's not going to be easy. It's not going to be quick. But together we can get through it. If you.
How Do I Get 50 Custody of My Child Los Angeles Family Law Attorney David Pisarra explains
Hey Guys, David Pisarra here with MensFamilyLaw. Do you want 50 of your kids let me tell you how that happens. The basic rule when it comes to child custody is that we keep the kids as stable as possible, wherever the kids are when you guys break up is most likely where the kids are going to stay, that's why you gotta be really careful about when you leave the house and why you need to read our Before You Leave guide which is a free download from our website mensfamilylaw when it comes to figuring out how much custody.
You're going to have of your children, you have to take aloof at the big factors and those factors are where the kids are going to school where mom lives, where dad lives how much distance there is between the two of them, where mom works, where dad works, how much distance from where they work to where the kids go to school. It really all boils down to availability and flexibility, the more flexible your work schedule is and the more flexible your time is. The easier it is going to be for us to go into court.
And get you the 50 custody of your children that you want. The other big factor that you have to be aware of is how old are the children. A young child is not going to be in the car for a long period of time comfortably. Judges know that. The older a child is the easier it is to say they can have a longer commute time. The problem that we run into is once a child has an established routine of living with mom, and short commute to school, maybe.
Dad isn't around a whole lot because he's working more, now it gets harder and harder for us to go into court and ask the judge to increase dad's custodial time. It can happen and we can do it if we can show that there's a decent amount of commute time between dads house and school and between moms house and dad's house. But remember when we're going into this, these are all the factors we have to juggle, so I want you to think about how close you are to where mom lives and the kid goes to school how close you are to where.
You live and work how close moms work is and how much availability you actually have in being flexible in your work schedule, because the more flexible your work schedule is the easier it is for us to make an argument to a judge that you should have equal custody time. Hope that helps, if you have other questions feel free to give me a call or shoot me an email. Check out the website and remember a cheeseburger and a chocolate shake will get you through just about everything, take care.
How Can I Get Custody of My Child
Getting custody of a child is not as simple as some are led to believe. It's not simply a matter of filing a petition in the Family Court, showing up and telling the judge that you're a great parent, having the judge award you custody. Custody is like any other case. You need to have good evidence. You need to present it persuasively, and since the ultimate determination of custody is the best interests of the child, you need to have covered a lot of issues. It is important if you are interested in getting custody of your child that you conduct yourself.
As an exemplary parent, and that starts well before you ever get to the courtroom, and certainly continues during that time period. You certainly don't want to be somebody who tests positive on a drug test. You certainly don't want to be somebody who is caught on an audio tape saying things about how you're going to keep the other parent from seeing the child. Everything is under a microscope in a custody case and to do well you have to convince the court that the child will flourish in your care.
Joint Custody Versus Sole Custody in Ontario
Hello, I'm Brian Galbraith, I'm the owner of Galbraith Family Law. We are a law firm of divorce lawyers located at Barrie, Newmarket and Orillia. I'm often asked, what is the difference between joint custody and sole custody Well, custody for lawyers means how you make decisions. In a joint custody regime the parents make decisions together. If one parent has sole custody, they make all of the major decisions. So, major decisions are those that relate to the health care, religious upbringing and education of your children. Of course, there can be some disputes as to what decisions are major, which ones are minor.
Day to day decisions are made by the parent who has the children under their care but those major decisions that have a significant impact on a children's lives are made jointly if you share joint custody. In Ontario the courts tend to assume that it's in the best interest of the children that both parents are involved in decision making but if there's evidence that the parents will be fighting and arguing and it will be not in the best interest of the children to have joint custody, then they'll order sole custody and give that.
Decision making part to one person. Now, often parents think that custody means the amount of time that the children spend with each parent. Well, that's not the case. Joint custody can occur even when the children are living primarily with one parent and the other parent just has access. So, often when people refer to joint custody, they assume it means that the children will be with both parents an equal amount of time. That is in fact, called shared custody. Confusing, isn't it Not sure why the term custody was used in two different contexts but from a legal.
Point of view, joint custody versus sole custody means how decisions will be made. Now, sometimes even if we have joint custody are going to have disagreements, so it's always best to see if you can work out those disagreements and come to a decision on your own, but if you need help, we sometimes send you to mediation where a neutral third party will help you discuss the issues and come to an agreement. Sometimes we have to go to court to get a judge to decide which point of view should.
Prevail, what's in the best interest of the children. Sometimes what we'll do is we'll hire a parenting coach who unlike a mediator can actually give you advice and make some suggestions as to what the best resolution of the issue is, and they'll help you work out an agreement. Whatever is needed we'll help you find the expertise so that you can make the best decisions for your children and your family. So, if this tutorial has been helpful, please give it a thumbs up. If you'd like more information or a consultation with.
How Do I Ask The Court To Get More Time With My Child Child Custody Expert David Pisarra Explains
Hey Guys, David Pisarra here with MensFamilyLaw. do you want to know how to ge tore time with your kids What's the procedure you go through in court let me answer that fore you The basic rule is this, there has to be some change in circumstance between the prior court order or the prior situation and the current situation. Something has to change to give a judge a reason to modify the current custody and visitation plan. That reason can be something along the lines of the child's changing schools and maybe they're now closer to where you live,.
That can be something along the lines of you got a new job and your hours have changed in such a way that now you're available to pick up your child every afternoon from school and spend the afternoon with them. It can be something along the lines of one of you has either become an addict, drug addict or alcoholic or has cured you drug or alcohol problem. the way that this is going to happen is you're going to file what's called a Request for Order in the Request for order you're going to explain to the judge what's changed.
And what you want to have in terms of new visitation or new custody schedule. Part of that is going to be a declaration. A declaration is just a letter to the judge under penalty of perjury that says I believe the following to be true and you lay out all the reasons why you should have a new custodial plan. If you're going to modify child support as part of this, which frequently happens because as the child custody switches now there's going to be a modification of the child support either that you pay or that you receive, you.
