How does a father get custody of his children? Now, there’sa myth out there that fathers never get custody of their children. This is based on the historicfact that, traditionally, mothers were primarily responsible for the care of children and fatherswere the bread winners. So it made sense, in those days, that thecourt would order custody to the mother since she was the one primarily looking after thechildren anyway. It was in the children’s best interested to be with their mother. Nowadays,both mothers and fathers usually participate
in the care giving and in earning the incomefor the family. As a result the Ontario courts are more inclined to order an equal time sharingregime for the children. If a father wants custody of his children,he needs to prove that it’s in the best interest of the children that he has custody. A strongargument would be that he was traditionally the one responsible or primarily responsiblefor the care, and that he can continue to provide the care that the children want anddeserve. Custody battles are often very nasty. They can take many months and even years toresolve and cost thousands of dollars in legal fees. The children often suffer when there’sa custody battle between their parents. As
a result we prefer to help our clients negotiatea settlement. One of the best processes to do that is calledcollaborative practice. That’s a process where the parties agree not to go to court and theywork with professionals to find a resolution to their petty issues and any other issuesthat they have to resolve related to the separation. The first thing you need to find out is do you have a parenting plan in place right now? A parentingplan is a set of rules that the court uses to determine who getsyour child when versus the other parent. If you currently have aparenting plan then you need to stop and you need to considerfiling a modification of the parenting plan because somebodyalready has custody of your
children. Now, if there’s not aparenting plan in place then you need to file a petition for aparenting plan. Or if you’re married, you’re going to needto file for divorce or legal separation in order to get aparenting plan put in place. The court looks at a variety offactors in determining who should be the primary custodianin a parenting plan. The court is going to look at the strengthand nature of your relationship with your child in otherwords, how strong is the bond
that you have versus how strongis the bond with the other parent. Take a look at thestability of your life. Are you in a stable situation? Doyou have employment? Is your employment flexible? Forexample, if you need to, can you get off work early to pickupyour child from school? These are the sort of factors thatthe court will need to look at. Also, they’re going to look atother factors such as drug or alcohol use, or if someone has acriminal history, or a history
of domestic violence. These lastfew factors can radically affect a person’s right to see theirchild. In fact, they can result in supervised visitation ifyou have one of those factors present. Because you need to be aware what the factors are thata court considers when deciding who to place your children with.Are they going to place your children with you or are theygoing to place your children with the other person.
